FORT LAUDERDALE, Fla. – Officials in Broward County are looking at fines for misdemeanor marijuana possession, rather than arrests and criminal charges.
County commissioners are scheduled to discuss a proposed ordinance Tuesday that would allow law enforcement officers to issue civil citations instead of filing criminal charges against people carrying 20 grams or less of marijuana. The proposed civil fine is $100 for the first offense and $250 for repeat violations. The fine could be waived for community service.
Under the county proposal, civil citations wouldn’t be allowed if marijuana is found in conjunction with other crimes.
Florida law makes misdemeanor marijuana possession punishable by up to 1 year in jail and a $1,000 fine.
If initial approval is given, a public hearing will be set for Oct. 27.
Miami-Dade County approved a similar ordinance earlier this year.
