JACKSON, Miss. (AP) _ Prosecutors want a federal appeals court to reconsider a ruling that could free a reputed Ku Klux Klansman serving a life sentence in the 1964 abductions of two black teenagers who were later killed.
James Ford Seale was convicted in June 2007 on kidnapping and conspiracy charges related to the abduction and slayings of Charles Eddie Moore and Henry Hezekiah Dee.
The 73-year-old Seale's conviction was overturned September 9.
A panel of three 5th U.S. Circuit Court of Appeals judges ruled the statute of limitations for kidnapping had expired in the more than 40 years between the abductions and Seale's arrest.
The government on Tuesday asked the panel to reconsider. If the panel stands by its ruling, prosecutors want the full appeals court to consider the case.
