The attorney arguing the case on behalf of the county, Mathew Staver from the Liberty Counsel, says he will file notice of appeal Tuesday with the 11th U.S. Circuit Court of Appeals in Atlanta.

The Dixie County Commission voted unanimously last week to appeal Judge Maurice Paul's decision requiring the six-ton granite monument be removed. Commissioners also are seeking a stay on the order the monument be removed by the middle of August.

Paul decided in favor of the American Civil Liberties Union Florida which brought the suit in 2007.
