Lawyers for the group filed a motion in U.S. District Court on Monday, saying the exams may be flawed. A ruling has not been issued.

City fire commissioners approved the promotions of the 10 firefighters on Friday, based on the 2003 tests. Those firefighters, who include four minorities, were not plaintiffs in the Supreme Court case.

The high court ruled in June that white firefighters' civil rights were violated when the city threw out the 2003 test results because no blacks would have been promoted. Fourteen firefighters who sued are being promoted.
